EPA Final NESHAP/MACT Standard

MUNICIPAL SOLID WASTE LANDFILLS  
(40 CFR Part 63 Subpart AAAA)

EPA has finalized its National Emission Standards for Hazardous Air Pollutants (NESHAPs) rules for Municipal Solid Waste (MSW) Landfills.

The final rule requires all existing and new MSW landfills to meet the requirements of 40 CFR Part 60, Subpart Cc [Emission Guidelines and Compliance Times for Municipal Solid Waste Landfills] or WWW [Standards of Performance for Municipal Solid Waste Landfills] and requires the timely control of bioreactors.  Affected landfills must prepare Startup, Shutdown and Malfunction (SSM) Plans and meet other requirements contained in the General Provisions to 40 CFR Part 63.  Semi-annual compliance reports are required to be submitted to the U.S. EPA or other delegated authority.

 Affected Sources

 (1)   Qwners/operators of MSW landfills that have accepted waste since November 8, 1987 or has additional capacity for waste deposition and meets any one of the following:

bullet

The landfill is a major source of air emissions (> 10 TPY of any one HAP or > 25 TPY of a combination of HAPs);

bullet

The landfill is co-located with a major source; or

bullet

The landfill is an area source that has a design capacity equal to or greater than 2.5 million mega grams (2.75 million tons) and 2.5 million cubic meters and has estimated uncontrolled emissions equal to or greater than 50 mega grams per year (55 TPY) of non-methane organic compounds, calculated according to the methods in 40 CFR Part 60, Subpart WWW.

(2)   Owner/operators of MSW landfills that have accepted waste since November 8, 1987 or has additional capacity for waste deposition that includes a bioreactor and that meets any one of the following:

bullet

The landfill is a major source of air emissions (> 10 TPY of any one HAP or
> 25 TPY of a combination of HAPs);

bullet

The landfill is co-located with a major source; or

bullet

The landfill is an area source that has a design capacity equal to or greater than 2.5 million mega grams (2.75 million tons) and 2.5 million cubic meters and that is not permanently closed as of January 16, 2003.

(3)   A new affected source is one that commenced construction or reconstruction after November 7, 2000 and meets the criteria mentioned above.

 Compliance Dates

New landfills must comply with the rule requirements by January 16, 2003 or upon startup.  Existing landfills must comply with the rule requirements by January 16, 2004. Those sources requiring the installation of collection and control systems per 40 CFR Part 60, Subpart WWW may have later compliance dates.
