WV Proposes Amendments to NSR and PSD Rules

The EPA is proposing to approve the Nonattainment New Source Review (NSR) and Prevention of Significant Deterioration (PSD) revisions to the West Virginia State Implementation Plan (SIP).  These proposed SIP amendments are in response to the revised Federal NSR and PSD regulations which were published on December 31, 2002 and became effective on March 3, 2003.  The Federal rule changes are commonly known as “NSR Reform.”

For NSR Reform, State and local permitting agencies were required to adopt and implement the minimum NSR Reform program elements by January 2, 2006.  West Virginia has developed a program that closely reflects the Federal NSR regulations at 45 CSR 19 for Nonattainment NSR and at 45 CSR 14 for PSD.  Both rule changes are acceptable to EPA.
